Why 44 days and not 60 days or more? Has empirical evidence shown that 44 days is appropriate?
The City should consider whether limiting these procedural rights to surrounding property owners unintentionally excludes occupants who may be directly affected by developments. Consideration should be given to recognising lawful occupiers or affected residents in defined circumstances.
The definition of surrounding owner relies entirely on cadastral boundaries. Planning reality is different in townships.
