I welcome the City of Cape Town's efforts to improve transparency and public participation through the proposed Municipal Planning Amendment By-law, 2026. The introduction of mandatory public notices for building plan approvals and improved access to approved plans are positive steps towards greater accountability.
However, I am concerned that the proposed consent-based rectification process may limit the City's ability to correct administrative errors where a beneficiary refuses consent, even in cases where a significant procedural defect has occurred. While legal certainty is important, the amendment should also ensure that the public interest and procedural fairness are adequately protected.
