About

We manage informal trading in Cape Town.

The Informal Trading By-law assists us to declare an informal trading plan for any place or area within our control. The plan identifies dedicated, restricted or prohibited areas for informal trading in that place or area.

Informal trading in the Trafalgar Flower Market is currently not governed by an Informal Trading Plan. We have identified a need to develop a trading plan for the area, to better manage and regulate informal trading in the flower market.

Approval from Council is required as part of the process before any area can be defined as an informal trading plan area.

In terms of section 17 of the Local Government: Municipal Systems Act, Act 32 of 2000, you can submit comments to the municipality in respect of the draft informal trading plan.

james ricketts6 months ago Considering the other comments, and from my experience regarding informal trading in CT and suburbs, and in particular to this plan: The permit should not be valid so long that it complicates a possible need to have a trader leave (for various reasons), without having to go through a legal process; The permit should not be so short that it requires a monthly process to renew permits, and is insecure/unstable for traders; therefore 6 months is potentially reasonable, and the extension process simple. Traders should as a group have atleast two representatives voted by them to represent them in all Trading matters (including permitting, excepting for their own applications), for their specific trading location Trading should never be on a sidewalk Trading should never be in front of pedestrian-facing businesses/shopfronts For some areas, discretion by the decision-makers (incl. the 2+ trader reps) should be considered to not demarcate exact, limited boundaries per trader, especially by painting on the ground. Ofcourse this has benefits in managing areas and avoiding conflicts, but at the same time can also make a trading area overly controlled and lose it's organic or spacial flair. Trading space fee's should be paid monthly and not allowed to go beyond 14 days overdue, allowing some leniency but also time to prep anyone on a waiting list to take over at end of the month Tables, benches, racks and shelter for trading on should either be supplied (as part of/or for additional costs) or atleast specified to be of the same design range, ensuring that there are no "flappy" or unsightly plastic sheets blowing in the wind, or frames collapsing and injuring shoppers or traders (for example) Electrical points per trader or groups of traders, water, drainage and ablutions should be provided No more than one allocation/trading bay per lessee - and only by actual person using the spot. There have been many examples of several bays/areas paid for by a single person or entity who sublets their spots to others for control or much larger fee’s The fee should be substantive, as opposed to just being a token fee. ie it should cover some necessary expenses to make the usage of real value (like as mentioned in ‘8’). Too cheap and incentives for good value to residents and passers by are lost. The goods traded should reflect the needs and desires of the community living in the area. A vote d in resident and representative of the community should be in the group/committee deciding on trading matters there.
